Recent Successes
June 2009 - Mistrial - Seattle Municipal Court. Mr. Vargas's client was charged with DUI and the case went to trial after numerous motions were litigated. As a result of the motions the client's breath test results were suppressed prior to trial. The case resulted in a mistrial after the investigating officer testified about evidence which was suppressed. A motion to dismiss the case for governmental misconduct is now pending.
May 2009 - Reduction Of Charge - Pierce County Superior Court. Mr. Vargas's client was charged with vehicular assault. The client's blood alcohol concentration was .23 and she was alleged to have been driving at more than 90 miles per hour when she flipped her vehicle injuring her passenger. As a result of Mr. Vargas's investigation the prosecutor agreed to reduce the charge to DUI, a gross misdemeanor.
April 2009 - Not Guilty Verdict - King County District Court, West Division, Redmond Courthouse.
November 2008 - Not Guilty Verdict - Benton County District Court. Mr. Vargas represented a client who was involved in a collision and who allegedly had a blood alcohol concentration of .16. The blood test result was admitted before the jury but the jury returned a not guilty verdict in 20 minutes.
