What do you mean I could lose my license for smoking a joint?
By Diego Vargas | May 22, 2009You will lose your license if you are convicted of possessing marijuana and you are 13 years old or older and under 21 years old.
Possession of less than 40 grams of marijuana is a misdemeanor punishible by up to 90 days in jail and or a fine of $1,000. See RCW 69.50.4014. The mandatory minimum punishment is 1 day in jail and a fine of $250, for a first offense. In addition, if you are 13 years old or older and under 21 years old then your license will be suspended.
If you are convicted of possession of marijuana then RCW 69.50.420 requires the court to notify the Department of Licensing (“DOL”) of the conviction. This notification results in a suspension pursuant to RCW 46.20.265. Now, RCW 46.20.265 states, “[u]pon receipt of the first notice, the department shall impose a revocation for one year, or until the juvenile reaches seventeen years of age, whichever is longer.” This means that your license would be suspended for at least one year but possibly longer if you are under 16 years old.
