Take Control – How To Assist Your DUI Defense Lawyer
By Diana Lundin | April 3, 2009For most people arrested for DUI, feelings of frustration can be overpowering. Folks find themselves caught in a system that they don’t understand, controlled by cops and prosecutors. Even hiring an experienced DUI defense attorney doesn’t always remove this feeling of helplessness. While it’s true that much of the courtroom drama is out of your control, there are things you can do to assist your lawyer in responding to alcohol-related criminal charges. Some of these tips may seem obvious, but even the small things can make a difference in how smoothly your case runs. First, make sure that your correct address is updated with the DOL, the court and your attorney. Often things are made more complicated when information, including court dates or correspondence related to driving privileges, doesn’t make it’s way to you timely because an old address is still on file. Second, don’t delay your response to whatever you are facing. Rarely do legal problems lessen when they are ignored. To the contrary, they are almost always compunded by failing to respond. Third, take any actions recommended by your attorney that show you to be an individual who takes responsibility for the situation. Even if you believe you are not criminally culpable, you should address probable concerns. For example, if you are accused of an alcohol related offense, you will be expected to obtain an evaluation from a certified treatment provider to determine whether or not you have a substance abuse problem. Following through with this does not mean you can’t challenge the case against you, but it communicates your understanding of the kinds of concerns society might have, and it shows that you are not afraid to take measures to address them, even if you feel you have done nothing illegal or improper. When your attorney advises you to enroll in educational classes, do so without haste. Again, it signals your responsiveness to the seriousness of the situation and makes it more likely that the prosecutor and/or judge will be receptive to you. These actions will help you feel more involved in your case and can reduce feelings of powerlessness. So, take control and help your attorney help you !!
